Ukraine

A multilateral air service agreement between EU and its Member States and Ukraine was signed in 2021. The agreement has not yet entered into force but is applied on a provisional basis. The agreement replaces the bilateral agreements between Ukraine and EU’s Member States.

However, existing traffic rights agreed in the bilateral agreements, which are not covered under the multilateral agreement, may continue to be exercised, provided there is no discrimination between the Member States and their nationals. 

The agreement contains transitional arrangements.

The agreement aims at integrating Ukraine in a wider European Common Aviation Area. The respective aviation markets will open gradually as Ukraine align its legislation with EU aviation rules and standards.

Traffic rights

For air carriers of EU: 

Points in EU – intermediate points in the territories of European Neighbourhood Policy partners*, ECAA countries**, Iceland, Lichtenstein, Norway or Switzerland – points in Ukraine – points beyond.

For carriers of Ukraine:

Points in Ukraine – intermediate points in the territories of European Neighbourhood Policy partners, ECAA countries, Iceland, Lichtenstein, Norway or Switzerland – any points in the European Union.

The services shall originate or terminate in the territory of EU for air carriers of EU and in Ukraine for air carriers of Ukraine.

During the transition period, unlimited third and fourth freedom rights may be exercised between points in the EU and points in Ukraine.

After the transition period, the agreement shall be fully implemented. Carriers of the EU and carriers of Ukraine will be permitted to exercise full traffic rights between the points mentioned above. EU carriers will also be permitted to exercise unlimited traffic rights between points within the Ukraine, whether or not such air services originate or terminate within the EU.

*Countries in the European Neighbourhood Policy partners are Algeria, Armenia, Azerbaijan, Belarus, Egypt, Georgia, Israel, Jordan, Lebanon, Libya, Morocco, Palestine, Syria, Tunisia and Ukraine.

**Countries in the ECAA are Albania, Bosnia and Herzegovina, Kosovo, Montenegro, North Makedonia and Serbia.
