Check of criminal records

A check of criminal records is part of the background check that an employer must perform for staff in accordance with the Swedish Transport Agency´s regulation on background check and requirements on competence - aviation security and section 14 of the Security Protection Act (1996:627), and section 26 of the Security Protection Ordinance (1996:633).

The Swedish Transport Agency is responsible for submissions to the Security Service for checks of criminal records in accordance with section 27 of the Security Protection Ordinance .

Authorization to apply

In order for the Swedish Transport Agency to ensure that correct persons are checked for the right reasons, the air carrier/airport or other concerned entities must submit the form Application to the swedish Transport Agency for check of criminal records. before the first application for a check of criminal records. The original form shall be sent by mail to the Swedish Transport Agency and only the notified persons are authorized to apply for a check of criminal records.

There must be a legitimate reason to do a check of criminal records. The requirement for background check is mandatory for the following categories of staff and only applications related to those categories can be considered as a legitimate reason:

  • Staff with unescorted access to security restricted areas or security areas.
  • Staff with crew identifications cards
  • Security staff
  • Persons with access to restricted informaton about aviation security
  • Security managers
  • Instructors training security staff

Applications for a check of criminal records

The form Application for check of criminal records must be used. Please note that if mandatory information is missing the application cannot be processed. The application must also be signed by the person beeing checked and person/s notified and authorized to apply in accordance with the "Application to the Swedish Transport Agency for check of criminal records" form.

Applying entity

The applying entity is normally the employer i.e airport, air carrier or other entities.

Employer

Employer is the company or the organization using a subcontractor that is the applicant entity. This may relate to work, constructions etc. at the airport or at other concerned entities.

Subcontractor

A subcontractor is the company that has been engaged by an applicant company.

Time limitation

If an assignment related to a records check is limited in time, this must be stated and the validity of the check will expire when the stated period ends.

Airport/Place of duty

State the airport that the request is related to. For air carriers, it shall be the airport where crew/staff is stationed. If there is more than one location of employment, all locations must be listed.

If the Swedish Transport Agency is not informed concerning current locations of employment, there is a risk that a person is deregistered and that the validity of the records check expires.

Foreign citizens

For foreign citizens it is important to state the country of citizenchip, birthplace abroad, passport number or the last address in state of residence. Please note that all information must be compleated.

How long does a check of public records check take?

A check of criminal records normally take 10 days from the time that the application is forwarded to the Security Service; in certain cases it might may take longer.

“Secondary companies”

“Secondary companies” are companies that request checks of criminal records for staff that is already checked through another company.

In spite of the fact that the person concerned has an active records check trough another company, it is still required that a new request is submitted by the new employer. This is important because the Swedish Transport Agency must keep its records updated in regard of the current employer.

Fee

The Swedish Transport Agency charges an administrative fee for a check of public records. The fee for the first check is 730 SEK. For a person that has been checked previously, the fee is 430 SEK.

Therefore it is important that the applicant fills in the billing information on the "Petition to the Swedish Transport Agency for check of criminal records" form.

Deregistration

A checked person is continously monitored against the criminal records, it is therefore important that the applicant of a check of crminal records informs the Swedish Transport Agency when staff ends their employment or change to duties not covered by the requirement. The deregistration is requested through the "Request for deregistration of staff" form.

Information on criminal history

Where appropriate, the Swedish Transport Agency will conduct a security investigation when persons have a criminal history. In accordance to the Security Protection Ordinance, the decision following such an investigation cannot be appealed.
