Category 5

Find here information which may be relevant if you apply for a permit to fly unmanned aircraft of category 5.

You may apply for a category 5 permit if you wish that certain operations be exempted from the requirements of category 1-3. Category 5 is divided into three subcategories: 5A, 5B and 5C.

Category 5A

A category 5A special permit may be granted for flying more than 120 metres above the ground or the water, if the flight takes place in the vicinity of obstacles such as masts and buildings. In these cases, the unmanned aircraft must not be flown at a greater horizontal distance from the obstacle than 50 metres, or at a greater vertical distance (measured from the obstacle's highest point) than 50 metres.

This permit implies an exemption from the category 1-3 requirement that unmanned aircraft, when flown in uncontrolled airspace, must stay below 120 metres from the ground or the water.

A category 5A permit may be granted as a separate permit or as a supplement to an existing category 2–3 permit. If it is granted as a supplement, the requirements for the exiting permit must also be met. If the application concerns a separate permit, the requirements for the category corresponding to the weight of the unmanned aircraft in question, must also be met. If the unmanned aircraft corresponds to category 1, it must also be equipped with a built-in fail safe system with the ability to interrupt the flight in case of loss of the control link, for example.

Application and validity

If the application concerns a supplement to an existing permit, a reference shall be made to the existing permit. State the name of the organisation which holds the permit, and the permit number.

If there is no existing permit and the unmanned aircraft belongs to category 1, the following information is to be given in the application:

  1. Name or company name;
  2. personal or corporate identity number;
  3. full address, telephone number and e-mail address; and
  4. name of the person responsible for the operations.
  5. the pilot's name and personal identity number.
  6. a copy of the insurance certificate (this does not apply to model aircraft of less than 20 kilos, nor to aircraft of less than 20 kilos used for non-commercial operations).
  7. The unmanned aircraft's:
    a) type;
    b) manufacture and model;
    c) weight;
    d) dimensions;
    e) propulsion system and number of engines; and
    f) flight control system.
    g) a description of the unmanned aircraft's fail safe system.

If there is no existing permit and the unmanned aircraft belongs to category 2-3, you must first make an application for that category.

Unless the Swedish Transport Agency has revoked a permit or the permit holder has cancelled it voluntarily, a category 5A permit – if it is a supplement to an existing category 2–3 permit – will be valid for an unspecified period of time. Otherwise a category 5A permit will be valid for a specified period of time which is determined from case to case, depending on type of operations.

Category 5B

A category 5B special permit may be granted for flying beyond the pilot's visual line of sight, the unmanned aircraft instead being within the visual line of sight of one or several observers. These observers must also monitor the air and the ground or water visually, in order for the unmanned aircraft to maintain a safe distance to other aircraft and to people, animals and property which are unrelated to the flight.

This permit implies exemptions from the following requirements:

Exemptions from category 1-2 requirements:

  • When flown, the unmanned aircraft shall be within its operational range and well within the pilot's visual line of sight (without the use of visual aids such as binoculars). The pilot has to take into consideration ongoing activities, topography including any obstacles, atmospherics, the influence of the weather etc.
  • The pilot shall monitor the surrounding airspace to be able to give way for any other air traffic.

Exemptions from category 3 requirements:

  • Flights must not be carried out unless the unmanned aircraft is flown within the pilot's visual line of sight. The actual distance is to be adjusted to the type of unmanned aircraft and the nature of the operations. The flight is to be carried out within the unmanned aircraft's operational range. The pilot has to take into consideration topography including any obstacles, atmospherics, the influence of the weather etc.
  • The pilot shall monitor the surrounding airspace to be able to give way for any other air traffic.

A category 5B permit may be granted as a separate permit or as a supplement to an existing category 2–3 permit. If it is granted as a supplement, the requirements for the exiting permit must also be met. If the application concerns a separate permit, the requirements for the category corresponding to the weight of the unmanned aircraft in question, must also be met. If the unmanned aircraft corresponds to category 1, it must also be equipped with a built-in fail safe system with the ability to interrupt the flight in case of loss of the control link, for example.

Clear communication must be established between the pilot and the observers, and the procedures for this communication shall be described in the application. The procedures should cover:

  • the type of communication equipment used;
  • the observers' tasks, and the measures to be taken in different situations (e.g. in case of intrusion into the safety area, or another aircraft approaching the flight area); and
  • any phraseology which will be used in the communication between pilot and observer(s).

If the application concerns a supplement to an existing permit, a reference shall be made to the existing permit. State the name of the organisation which holds the permit, and the permit number.

If there is no existing permit and the unmanned aircraft belongs to category 1, the following information is to be given in the application:

Category 5C

Unmanned aircraft operations which do not fall into any other category, might be carried out with a category 5C special permit. Examples of such operations may be flights beyond the visual line of sight in a special area, or flights at a greater height than 120 metres above the ground or water.

Submit the application to luftfart@transportstyrelsen.se. It shall contain the following information:

  1. General description of the operations, stating background, aim and purpose, with any limitations and restrictions.
  2. Description of the area where the flight will take place: type of ground overflown, type of airspace and height, and type of infrastructure found in the area.
  3. An account of how you have managed the risk of collision with third parties, in the air and on the ground, in the area in question. The account shall contain a general risk analysis with evaluations of the risks, impact study and action plan.
  4. Map of the flight area including coordinates (WGS84, DDMMSS).
  5. Description of the organisation, the staff and the office holders, if any. An account of the pilots' experience.
  6. Description of the unmanned aircraft system:
    a) technical specification and references to manuals;
    b) type of equipment;
    c) type of fail safe system (how do you ensure that the unmanned aircraft stays within the area in question?);
    d) general risk analysis with evaluations of the risks, impact study and action plan;
    e) operational statistics, if there are any;
    f) maintenance program, if there is one.
  7. Procedures for preparations, flights and follow-up work.
  8. Questions regarding communication and collection of weather data.

A category 5C permit will be valid for a specified period of time which is determined from case to case, depending on type of operations.
